1. Acceptance of Terms

By accessing the CharityPokerLV website (charitypokerlv.com), registering for an event, submitting a form, making a donation, or otherwise using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our website or services.

These Terms constitute a legally binding agreement between you and CharityPokerLV ("we," "us," or "our"), a Nevada-based charity poker event management company.

2. Regulatory Compliance

CharityPokerLV operates in full compliance with the following regulatory frameworks:

  • Nevada Gaming Control Board: We are approved by the Nevada Gaming Control Board to conduct charitable poker events pursuant to NRS Chapter 462 (Charitable Lotteries) and applicable Gaming Control Board regulations
  • NRS Chapter 463: Licensing and Control of Gaming — our operations comply with all applicable provisions governing gaming activities in the State of Nevada
  • NRS Chapter 462: Charitable Lotteries — all charitable poker events are conducted in accordance with Nevada law governing charitable gaming
  • NRS Chapter 463B: Charitable Gaming — compliance with provisions specific to charitable gaming operations
  • Federal law: Compliance with applicable federal statutes including IRS reporting requirements for charitable contributions (26 U.S.C. § 170) and anti-money laundering provisions (31 U.S.C. § 5311 et seq.)

We maintain all required licenses, permits, and approvals. We cooperate fully with Gaming Control Board audits, inspections, and reporting requirements.

3. Eligibility

To participate in CharityPokerLV events or use our services, you must:

  • Be at least 21 years of age, in accordance with Nevada gaming law (NRS 463.350)
  • Not be excluded from gaming activities under NRS 463.020 or any Gaming Control Board exclusion order
  • Provide accurate and truthful registration information
  • Not be under the influence of alcohol or controlled substances to a degree that impairs judgment
  • Comply with all applicable federal, state, and local laws

We reserve the right to deny participation to any individual who does not meet these eligibility requirements or who violates these Terms.

4. Event Registration and Participation

4.1 Player Registration

By registering to play in a CharityPokerLV event, you agree to:

  • Pay the posted buy-in amount at the time of the event
  • Follow all tournament rules, floor decisions, and house rules as posted and announced
  • Conduct yourself in a sportsmanlike manner at all times
  • Accept that all tournament decisions by floor managers and dealers are final
  • Understand that poker involves an element of chance, and losses are possible

4.2 Host Organization Registration

Charitable organizations that submit event proposals agree to:

  • Provide accurate information about their 501(c)(3) status or other qualifying charitable designation
  • Cooperate with CharityPokerLV in event planning, promotion, and execution
  • Comply with all Gaming Control Board requirements for charitable gaming events
  • Ensure that event proceeds are distributed in accordance with NRS Chapter 462

5. Charitable Gaming Rules

All CharityPokerLV events are conducted under the following principles, consistent with Nevada law and Gaming Control Board regulations:

  • Charitable purpose: All net proceeds from events are directed to the designated charitable organization. "Net proceeds" means gross revenue less reasonable and documented expenses for event operation
  • No house take: CharityPokerLV does not take a percentage of gaming proceeds. Our fees are paid by the event budget, separate from charitable distributions
  • Game integrity: All games are conducted with professional equipment, trained dealers, and floor supervision to ensure fair play
  • Reporting: We maintain complete records of all events, including attendance, buy-ins, re-buys, payouts, and charitable distributions, as required by the Gaming Control Board
  • Age verification: All participants must present valid government-issued identification proving they are at least 21 years of age

6. Donations and Sponsorships

6.1 Direct Donations

Donations made through our website are directed to the charitable organization associated with the designated event, or to the general charitable fund if no specific event is selected. Donations are voluntary and non-refundable.

Tax deductibility: Donations to qualifying 501(c)(3) organizations may be tax-deductible under 26 U.S.C. § 170. CharityPokerLV will provide receipts as required by law. Donors should consult their tax advisor regarding deductibility.

6.2 Sponsorships

Sponsorship agreements are separate contracts between the sponsor and CharityPokerLV. Sponsorship payments are made in exchange for marketing and promotional benefits and are not charitable contributions unless explicitly designated as such in the sponsorship agreement.

7. Prohibited Conduct

The following conduct is strictly prohibited at CharityPokerLV events and on our website:

  • Collusion, chip dumping, or any form of cheating
  • Use of electronic devices to gain an unfair advantage during play
  • Harassment, intimidation, or abusive behavior toward staff, dealers, or other participants
  • Underage participation (under 21 years of age)
  • Use of our website for any unlawful purpose
  • Submission of false or misleading information in registration or event proposals
  • Attempted manipulation of charitable gaming outcomes
  • Violation of any applicable federal, state, or local law

Violation of these prohibitions may result in immediate removal from an event, forfeiture of buy-in, and permanent ban from future events. We reserve the right to report violations to the Nevada Gaming Control Board and law enforcement authorities.

8. Intellectual Property

All content on the CharityPokerLV website, including text, graphics, logos, images, and software, is the property of CharityPokerLV or its licensors and is protected by United States copyright and trademark law. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

9. Disclaimers

AS-IS basis: Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Gaming risk: Participation in poker events involves financial risk. You acknowledge that you may lose your buy-in and any additional wagers. CharityPokerLV does not guarantee any outcome from participation in events.

10. Limitation of Liability

To the fullest extent permitted by Nevada law (NRS 41.670 et seq.), CharityPokerLV, its officers, directors, employees, agents, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill arising from your use of our website or services
  • Any damages exceeding the amount you paid to us in the twelve (12) months preceding the claim
  • Any event beyond our reasonable control, including but not limited to acts of God, power failures, or government actions

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless CharityPokerLV and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of our website or services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your conduct at any CharityPokerLV event

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict-of-law provisions.

12.2 Venue

Any dispute arising from these Terms or our services shall be resolved exclusively in the state or federal courts located in Clark County, Nevada. You consent to the personal jurisdiction of such courts.

12.3 Arbitration

At our election, any dispute may be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in Las Vegas, Nevada. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on our website with a revised effective date. Material changes will be communicated to registered participants via email. Your continued use of our website or participation in events after changes are posted constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CharityPokerLV regarding the use of our website and services, and supersede all prior agreements and understandings.
